Four of the most interesting domestic cases on international law

06:45
The Distomo cases, the Urgenda Foundation v The Netherlands case, the Alien Tort Statute cases and the Israeli targeted killings cases are among the most fascinating domestic cases on international law. The ability to read these cases in English on ILDC is invaluable for practitioners and scholars alike. This year marks the 10th anniversary of this remarkable online service: http://opil.ouplaw.com/page/ILDC  André Nollkaemper, ILDC Editor in Chief, and Professor of Public International Law and Director of the Amsterdam Center for International Law at the faculty of Law of the Universiteit van Amsterdam August Reinisch, ILDC Editor in Chief and Professor of International and European Law at the University of Vienna © Oxford University Press

8 Shocking Cases of Modern Day Piracy

10:43
8 shocking cases of modern day piracy. You won’t believe how dangerous today’s pirates are! Subscribe for new videos: http://goo.gl/SaufF4 8: The Seabourn Spirit attack Ever since the Somali Civil War entered its second phase in the beginning of the 21st Century, pirate activities off the coast of Somalia have been a threat to international shipping. It initially began when groups of Somali fishermen armed themselves to fend off foreign boats that illegally fished and dumped toxic waste in their waters. But the fishermen eventually turned to hijacking ships in order to steal goods and demanding ransom money as a source of income. In November 2005, Bahamian cruise liner Seabourn 7: The MS Melody attack As pirate attacks become more common, there have been calls for commercial ships to carry firearms. However, this would result in another problem as such ships are not allowed to dock at non-military ports. Some operators resort to hiring private security companies who board the ship as it reaches dangerous waters and leave once the threat has passed. In April 2009, the attack on MS Melody became the first case in which a pirate attack was thwarted by an armed private security team. The Italian ship was carrying 1500 passengers on a cruise from Durban, South Africa 6: The Inabukwa Hijacking Indonesian waters, alongside the Malacca and Singapore straits are among the busiest sea lanes in the world. For centuries, the Southeast Asian sea route has been essential for trade between the Far East and the rest of the world. With so much traffic and valuable cargo, it's not surprising that the area has a long history of being a pirate hotspot, a tradition which still continues to this day. In March 2001, Indonesian cargo ship Inabukwa was sailing through Indonesian waters with nearly 2 million dollars worth of tin ingots, zinc and white pepper. Suddenly a group of pirates armed with guns and knives stormed the vessel and forced the entire crew 5: Sir Peter Blake's Murder Peter Blake is one of the greatest yachtsmen the world has ever known, having won multiple medals and awards in the sport, and broke the fastest around-the-world sailing record in 1994. Blake's accomplishments earned him a knighthood, and he is regarded as a national hero in his country New Zealand. Sadly, he didn’t live a long life. In December 2001, at the age of 53, he was shot and killed by pirates on his yacht during an expedition on the Amazon River. Blake was on an environmental expedition in Brazil to monitor the effects of global warming and pollution for the UN 4: Judith Tebbutt's Kidnapping This case is rather unique in this list as Judith Tebutt and her husband David fell victim to piracy while they were on land. In September 2011, the British couple was on a fortnight's holiday in a luxury beach lodge on the shores of Kenya. They were the only ones staying in the place when it was raided one night by Somali pirates. After being forcefully awakened from her sleep, Judith 3: The MS Achille Lauro Hijacking Throughout the 70s and 80s, Palestinian armed militants had a reputation for hijacking commercial airplanes as part of their fight against Israel. However, their attacks are not limited towards aircrafts, as shown in the hijacking of the MS Achille Lauro in 1985. While most consider this an act of terrorism, we could also call it an act of piracy as it involved hijacking a ship at sea. As the Italian liner was sailing from Alexandria, Egypt, towards Ashdod, Israel, four Palestine Liberation Front (PLF) militants carrying machine 2: The SY Quest incident In February 2011, four Americans on vacation were sailing round the world aboard their yacht, the SY Quest. Unfortunately their fun ended when they were stormed by 19 Somali pirates while sailing 200 miles off the coast of Oman. With the four Americans as hostage, the pirates directed the yacht towards Somalia. In response, the US Navy dispatched several warships, including a guided missile destroyer to deal with the situation. They intercepted the pirates in the Indian Ocean a few days later, and two of the pirates were brought aboard one of the Navy ships to negotiate. The pirates were offered to take the yacht 1: The Maersk Alabama hijacking The hijacking of the MV Maersk Alabama in April 2009 is probably one of the most well known cases of modern day piracy due to all the international attention it drew at the time. Originating from Oman, the merchant vessel was bound for Kenya when it was raided by Somali pirates in a speedboat. Despite defensive measures taken by the American crew who had undergone anti-piracy training, four pirates managed to get on board. Still, the crew refused to give in. They managed to shut down the ship to prevent the pirates from controlling it, and locked themselves to safety in a secure room. Some crewmen actively resisted the invaders, and even managed to capture and tie up one of the pirates. Unfortunately, Captain Richard Phillips who commanded the ship

Why Sea Cucumbers Are Dangerous

14:01
Sea cucumbers are rather inconspicuous animals and are certainly not the most well-known sea creatures. They are nonetheless of enormous importance for the oceans and us humans. But don't get too excited because despite their harmless appearance they are actually not as safe to handle as one might think. In this video, you find out why. SDA Court Cases over the Sabbath. Walmart and Religious Discrimination. Liberty in the Workplace

Federal Government alleges Walmart denied Religious Accomodations to Assistant Manager https://legalnewsline.com/stories/511585434-federal-government-alleges-walmart-denied-religious-accommodation-to-assistant-manager Store Manager who is Adventist Sues Wal-Mart Because of Religious Discrimination https://atoday.org/store-manager-who-is-an-adventist-sues-wal-mart-because-of-religious-discrimination/ Wise Employment for the 144,000 and SDA: https://www.youtube.com/watch?v=rm0_41w_O8s We should jealously guard the edges of the Sabbath. Remember that every moment is consecrated, holy time. Whenever it is possible, employers should give their workers the hours from Friday noon until the beginning of the Sabbath. Give them time for preparation, that they may welcome the Lord's day with quietness of mind. By such a course you will suffer no loss even in temporal things. 6T 356 Soon God's people will be tested by fiery trials, and the great proportion of those who now appear to be genuine and true will prove to be base metal. Instead of being strengthened and confirmed by opposition, threats, and abuse, they will cowardly take the side of the opposers. The promise is: “Them that honor Me I will honor.” Shall we be less firmly attached to God's law because the world at large have attempted to make it void? Already the judgments of God are abroad in the land, as seen in storms, in floods, in tempests, in earthquakes, in peril by land and by sea. The great I AM is speaking to those who make void His law. When God's wrath is poured out upon the earth, who will then be able to stand? Now is the time for God's people to show themselves true to principle. When the religion of Christ is most held in contempt, when His law is most despised, then should our zeal be the warmest and our courage and firmness the most unflinching. To stand in defense of truth and righteousness when the majority forsake us, to fight the battles of the Lord when champions are few—this will be our test. At this time we must gather warmth from the coldness of others, courage from their cowardice, and loyalty from their treason. The nation will be on the side of the great rebel leader. The test will surely come. Thirty-six years ago I was shown that what is now transpiring would take place, that the observance of an institution of the papacy would be enforced upon the people by a Sunday law, while the sanctified rest day of Jehovah would be trampled underfoot. The Captain of our salvation will strengthen His people for the conflict in which they must engage. How often when Satan has brought all his forces to bear against the followers of Christ, and death stares them in the face, have earnest prayers put up in faith brought the Captain of the Lord's host upon the field of action and turned the tide of battle and delivered the oppressed. Now is the time when we should closely connect with God, that we may be hid when the fierceness of His wrath is poured upon the sons of men. We have wandered away from the old landmarks. Let us return. If the Lord be God, serve Him; if Baal, serve him. Which side will you be on? Canada Passes A Law Granting Drug Possession Immunity In Cases Of Overdosing

06:50
New law would provide immunity from simple possession charges for those who call 911 in the case of an overdose. Grace and Amir tell you about Canada's latest effort to combat addiction. Let us know what you think of this new law. "Opioid overdoses are claiming the lives of thousands of Canadians of all ages and from all walks of life. The impact of the opioid crisis continues to be devastating to individuals, families, and communities. Many of these deaths are preventable if medical attention is received quickly, but evidence shows that witnesses to an overdose often do not call 911 for fear of police involvement. This is why the Government of Canada has taken action to encourage and protect people who are witnessing an overdose so they can seek help, and ultimately, save lives. The Honourable Jane Philpott, Minister of Health, the Honourable Ralph Goodale, Minister of Public Safety and Emergency Preparedness, and the Honourable Jody Wilson-Raybould, Minister of Justice, announced today that the Good Samaritan Drug Overdose Act received Royal Assent and became law. The Act provides an exemption from charges of simple possession of a controlled substance as well as from charges concerning a pre-trial release, probation order, conditional sentence or parole violations related to simple possession for people who call 911 for themselves or another person suffering an overdose, as well as anyone who is at the scene when emergency help arrives. The Act was originally introduced as a Private Member’s Bill by MP Ron McKinnon, the original Bill sponsor and Member of Parliament for Coquitlam-Port Coquitlam." Hey, guys! Maritime Cases are What We Do

00:53
What's different about our firm? 1) We are thoroughly experienced with maritime cases; these are the only types of cases we do. 2) We have the financial resources to back up a maritime case. Unlike many other cases, maritime cases cost a lot of money. 3) We have staff members experienced with maritime cases. 4) We know how to take a maritime case to court. Structure and Interpretation of Test Cases - Kevlin Henney

01:08:13
Throw a line of code into many codebases and it's sure to hit one or more testing frameworks. There's no shortage of frameworks for testing, each with their particular spin and set of conventions, but that glut is not always matched by a clear vision of how to structure and use tests — a framework is a vehicle, but you still need to know how to drive. This talk takes a deep dive into testing, with a strong focus on unit testing, looking at examples and counterexamples in different languages and frameworks, from naming to nesting, exploring the benefits of data-driven testing, the trade-offs between example-based and property-based testing, how to get the most out of the common given–when–then refrain and knowing how far to follow it. Justice: What's The Right Thing To Do? Episode 01 "THE MORAL SIDE OF MURDER"

54:56
To register for the 2015 course, visit https://www.edx.org/course/justice-harvardx-er22-1x-0. PART ONE: THE MORAL SIDE OF MURDER If you had to choose between (1) killing one person to save the lives of five others and (2) doing nothing even though you knew that five people would die right before your eyes if you did nothing—what would you do? What would be the right thing to do? Thats the hypothetical scenario Professor Michael Sandel uses to launch his course on moral reasoning. After the majority of students votes for killing the one person in order to save the lives of five others, Sandel presents three similar moral conundrums—each one artfully designed to make the decision more difficult. As students stand up to defend their conflicting choices, it becomes clear that the assumptions behind our moral reasoning are often contradictory, and the question of what is right and what is wrong is not always black and white. PART TWO: THE CASE FOR CANNIBALISM Sandel introduces the principles of utilitarian philosopher, Jeremy Bentham, with a famous nineteenth century legal case involving a shipwrecked crew of four. After nineteen days lost at sea, the captain decides to kill the weakest amongst them, the young cabin boy, so that the rest can feed on his blood and body to survive. The case sets up a classroom debate about the moral validity of utilitarianism—and its doctrine that the right thing to do is whatever produces "the greatest good for the greatest number."

Debacles I. Theory

01:35:17
http://www.mpi.lu/news-and-events/debacles-illusions-and-failures-in-the-history-of-international-adjudication/news/ International conference: “DEBACLES – Illusions and Failures in the History of International Adjudication” On 24-25 November 2016, the Max Planck Institute Luxembourg for Procedural Law hosted the Conference “DEBACLES – Illusions and Failures in the History of International Adjudication”, a milestone of the research project on failed international courts and tribunals currently pursued in the Department of International Law and Dispute Resolution. Against the backdrop of the post-Cold War rise of international adjudication, the DEBACLES project, inaugurated in 2015, aims to cast an unconventional light on the history of international adjudication, bringing to the foreground its many illusions and failures, the paths not taken and, more generally, the nonlinearity of its developments. During the two-day conference, 27 seven speakers took the floor under the chairmanship of 6 renowned scholars. The speakers engaged with specific failed attempts to create and operate international judicial forums, as well as with broader historical and theoretical issues related to such failures. First among these was the clarification of the very concept of ‘failure’ and the identification of its subjective and objective dimensions. The conference offered a rich inventory of cases of failure arranged in two methodological panels (History and Theory) and four thematic panels on — respectively — Human rights, International economic law, Regional international organisations, and International criminal law. Prominent and outwardly thriving institutions — including the International Court of Justice, the Court of Justice of the European Union and the International Centre for Settlement of Investment Disputes (ICSID) — were examined along with lesser-known or almost forgotten ones. In the Theory panel, chaired by Prof. Moshe Hirsh, Dr Luca Pasquet discussed the multifaceted concept of failure using the heuristics of disappointment. Professors Paula Wojcikiewicz Almeida and Serena Forlati tackled the question whether and to what extent non-compliance with judgments may be counted as a failure of International adjudication. Dr Wim Muller talked about claims brought against Great Powers, in particular the Nicaragua, the Arctic Sunrise, and the South China Sea cases the, and assessed the evidence according to which these cases seem destined for failure. Chair: Prof. Moshe Hirsch Dr Luca Pasquet - Failure as Disappointment Prof. Paula Wojcikiewicz Almeida and Prof. Serena Forlati - Is Non-compliance with Judgments a Failure of International Adjudication? Increase in Lese Majeste cases in Thailand

02:45
One of the most controversial topics inside Thailand is the use of the Lese Majeste laws, which were introduced in the 19th century to protect the monarchy from criticism. Unlike similar laws that have fallen into disuse elsewhere, Thailand’s courts are seeing more and more Lese Majeste charges filed for offenses that sometimes seem to be only tenuously connected to the monarchy. Dana Campbell - Hunted by land and sea

03:31
Voiceless CEO, Dana Campbell, discusses the organisation's work in animal law and the protection of kangaroos. Part of the 2012 Animal Law Lecture Series. This year Voiceless explored legal comparisons between the commercial hunting of seals in Canada and kangaroos in Australia. Our keynote speaker, Lesli Bisgould, shared her legal insights from Canada and local speakers gave a legal perspective on the commercial hunting of kangaroos in 12 venues nationwide. Dana joined Voiceless as the organisation's first CEO after working for nearly 12 years as a senior lawyer for the Animal Legal Defense Fund in the U.S. There she focused on pushing animal law forward through her legal work on animal cruelty cases; training of law enforcement, prosecutors, and legal professionals; and pursuit of innovative legal theories in the courts. In New York, Dana established and taught Cornell Law School's first Animal Law class, and continued to do so for 4 years. She previously taught Animal Law and Advanced Animal law classes at Lewis and Clark Law School in Oregon and Vermont Law School. Immediately following her law school training, Dana worked for 5 years as a public prosecutor in Oregon and Hawaii, specializing in cases involving animal cruelty and family violence, which made her keenly aware of the connection between the two. She was a founding member of the Maui County Hawaii domestic violence task force, and later consulted on the formation of animal cruelty task forces in several jurisdictions. Earned the American degrees of Bachelor of Science (majoring in Technical Journalism with a minor in Business Administration), and Juris Doctor.

[#RespectLawOfTheSea] N°3 Be humane ! Save lives at sea ! Respect the law ! - SOS MEDITERRANEE

02:09
Thrird Episode of our series #RespectLawOfTheSea on the occasion of the European Parliament elections in May 2019. Subject for this episode: This third video shows the administrative, political and judicial harassment received by Search and Rescue NGOs since 2017. Ships like the Aquarius of SOS MEDITERRANEE were stripped off their flag due to political pressure. Several investigations have been also launched against search and rescue ships and individual crew members. Most cases ended in acquittal or were discontinued due to a lack of evidence. The blocking of search and rescue NGOs is neglecting the duties and obligations of States and shipmasters to rescue people in danger at sea. An increasing number of people are at risk of drowning and the civil society can no longer witness and report on this humanitarian tragedy. SOS MEDITERRANEE refuses to accept this situation and calls on candidates running in the European Parliament elections to act in order to stop the administrative, political and judicial harassment of search and rescue NGOs and let them resume saving lives. "The quality of litigation has undergone a sea change"

08:08
Mr. Dushyant Dave's father, who was a very successful lawyer and judge (initially a District Judge and then a Judge of the Gujarat High Court), sparked his interest in the law. Coupled with that, his love for law was borne out of his love for fiction. During his college days, when he read a lot of fiction relating to law, he took a final decision to take up law. Being the son of a judge meant he lived amidst judges and lawyers; according to Mr. Dave, one of the judges who inspired him a lot was Justice D. A. Desai (who went on to be a Supreme Court Judge and Chairman of the Law Commission of India). He was a neighbour who took a liking to Mr. Dave, and inspired him by working himself up to be good in every branch of the law and giving many memorable judgments at the High Court and at the Supreme Court. Mr. Dave reminisced about his first case, which was some time in 1979. He had joined the practice of Mr. Majmudar, who later became a judge in the Supreme Court, for a short stint. Just a few weeks into the Bar, a brief was thrust in Mr. Dave's hands and he was told to go argue it in the next half hour! That experience gave him confidence and encouraged him -- it was an interesting short question under the Gujarat Land Revenue Act and not only was it an eye-opening experience; it was also a real pleasure. We then asked him about how he thinks the life of a litigating lawyer has changed. He feels that things have changed a lot since he himself was a junior. The stipend they got as juniors was negligible, because it was considered to be an honour to be someone's junior, it wasn't considered a paid position. There was no remuneration, but he needed the money to survive, as his father was no longer in Ahmedabad. But fortunately, his senior permitted him to have a private practice and in a year's time, he was appointed to appear as the State Government Counsel for some firms, which gave him a chance to appear in hundreds of cases before some excellent judges. And that was the opening, the foot in the door, so to speak. He feels that things are different today: the cost of living has increased and it is difficult for young lawyers to sustain themselves in a big city without a decent income. "Today's lawyers are getting tremendous openings, even with counsels like us." The change has been in more than just the juniors' remuneration. While the litigation practice remains virtually the same, the quality of litigation has undergone a sea change. Today, there are all kinds of issues that are cropping up; you have every kind of civil or corporate laws being questioned before the courts. The stakes are higher, the importance of cases is more, and corporate warfare has increased. He added that one of the biggest areas of development in litigation is public law, particularly government tenders, because there is immense infrastructure development. Especially for counsels in Delhi, in the Supreme Court, there are some incredible opportunities, and they get to travel all over, to different High Courts where these issues come up.
